A 28-year-old man, Rotimi Akinkuotu, has been dragged before the Chief Magistrate Court in Ondo town, headquarters of Ondo West Local Government for allegedly obtaining the sum of N7 million under false pretence.
Akinkuotu, a policeman, who appeared before Magistrate Bolatito Ajibade, was accused of allegedly duping one Olabisi Temidayo, under the pretence of supplying him tons of cocoa beans.
It was gathered that the defendant reportedly conspired with others to collect the money reneged on his promise after he failed to supply the buyer with the produce.
Akinkuotu, who was arraigned with charge number MOD/148c/2019 was said to have committed the offence in January 2019 which is contrary to and punishable under sections 516,419 and 390(9) of the Criminal Code Cap 37, Volume 1 Laws of Ondo State of Nigeria, 2006.
The charge sheet read in part, “That you, Rotimi Akinkuotu, and others in charge number MOD/ 148c/2019 sometimes in the month of January 2019, in Ondo town in the Ondo Magisterial District did conspire together to commit felony to wit obtaining money under false pretence and stealing and thereby committed an offence contrary to and punishable under section 516 of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria, 2006.
“That you, Rotimi Akinkuotu and others in charge number MOD/148c/2019, in the same date, and place, in the aforementioned Magisterial District did fraudulently obtained the sum of N7,000,000 from one Olabisi Temidayo, under the pretence that you will supply tons of cocoa beans to him which you know to be false.
“That you, Rotimi Akinkuotu and others in charge number MOD/148c/2019 in the same date, and place, in the aforementioned Magisterial District did steal the sum of N7,000,000, property of one Olabisi Temidayo and thereby committed an offence contrary to and punishable under section 390(9) of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria 2006.
The police prosecutor, Saheed Anifowose, notified the court that he would be calling three prosecution witnesses to testify in the case. He, therefore, applied for a date to enable him study the case file while the defendant’s counsel, Mr. Oladiran Olajide, also applied for the bail of his client in most liberal terms.
Magistrate Bolatito Ajibade, however, granted the defendant bail in the sum of N500,000 with two sureties in like sum, who she added must produce evidence of payment of tax.
The case was subsequently adjourned till December 9, 2019.
